We meet again tonight :p

This is suppose to be a very short entry and should not be bothered much but I'm clueless & confused!
Am I so happy or am I actually facing a problem?

Problem:- LOVE BIDDING ITEMS AT ONLINE SHOPPING!

Urgh! At times I would be sooo happy when I win those bids. For certain things, it is very cheap and I dont mind spending some for items that are hard for me to find with great offer and also, there are also things that I wont regret having and spend since they are cheap. But, how cheap are them? Urghhhh!!!

I wont talk about the price. I am talking about the total amount spent for all the bidding items. If it is a single item, it can be defined as cheap literally. But what about lots of items? OH NO! But I find this very interesting! Why? It is unnecessary to have cash with me to pay but it is done through transferring to the 3rd party account or I just bank-in to the said account. Haih, this is actually dangerous! We might didnt realise about the flow of money. I'M SO DEAD! 

I might stop after this. I had stopped from this two years back until last week I started again and it give me more when I won some bids hehe..And somemore, I also won for something tonight! This is what I've been searching and look for! I got daymn cheap price, compared to other bids on the same item! REALLY GLAD! hahahahha! berlagak giler hehehehe :p  For item like that, with the price, I really dont really mind :D So satisfied! As for the time being la hehehe..

However, I should know on the consequences of buying items online. So far, I think I still manage to keep track for every items and price as I would check on my budget before I bid such item :) This to secure me from any other consequences. 

Oh ya, there are few tips for bidding items. Keep it on your watch list, or you may just have that page available on your screen. Keep refreshing that page and look for the bidding price, end time and time left. When it is on your budget, bid it when it almost ends; for example another 1-2 minutes left. Nobody could catch up with up within that time, as they may think that nobody would challenge them with higher bids :D And so how it goes to me hahahah! I learnt from them also as I wanted such item but I lost the bid just before the time ends. And now I am practicing from my experience :) Experience is the best teacher, isnt it? :D

Few tips after the auction closed. Wait for the seller to send you email on payment method and also notification email that you are the winner of the auction. Only later when everything is ratified including the shipping address, you may proceed with the payment. Do not forget to save the scree-shot if you do online transfer, and also the receipts if you bank-in/transfer the money through ATM. It would be treated as evidence before the seller proceed with the delivery after they are acknowledge with the payment. 

But as for online shopping without auction, it is necessary for you to make payment directly to the seller and notified them. However, you should be extra-careful with that. You may negotiate with the seller to put on deposit and not the total amount until the delivery takes place. But shopping through online need you to have confidence with the seller and the web host. This is to avoid any unwanted scenes. 

In Malaysia, there are few online shopping based on auction. There are a lot more to be uploaded, but maybe later. I'm sleepy now! :(

As for now, I AM SOOOO SATISFIED & HAPPY FOR THE PREVIOUS BID ITEM! Sukeeeee!! (^.^)v    Now I can mimpi2 dengan bestnye, waiting for their email before I proceed with the payment transaction and wait for the item to arrive next week. Yeehaaaaaaaaaaaaaaaaaa! :p

Apakah itu AKDN atau ISA?
Akta ini adalah salah satu undang-undang pencegahan yang digubal di bawah perkara 149,Perlembagaan Persekutuan. Ia telah dikuatkuasakan di Semenanjung Malaysia pada 1 Ogos 1960 dan diperluaskan penguatkuasaannya di Sabah dan Sarawak pada 16 September 1963.

Apakah tujuan tujuan ISA?
Tujuan ISA adalah untuk mengelakkan dari berlaku ancaman keselamatan, ketenteraman awam dan keamanan negara yang dilakukan oleh individu atau kumpulan tertentu yang bertujuan menganggu-gugat keamanan dan kestabilan negara.

Pernahkah ISA dipinda?
ISA pernah dipinda beberapa kali pada tahun-tahun berikut:
   1) 1962
   2) 1963
   3) 1964
   4) 1965
   5) 1966
   6) 1969
   7) 1989

Apakah contoh-contoh kes yang membabitkan tindakan ISA?

Kenapa tidak digunakan Ordinan Jenayah sedia ada?
ISA tidak bermotif untuk menganayai sesiapa juga yang ditahan oleh polis. Mereka ditahan berasaskan kepada kegiatan-kegiatan yang boleh mengganggu-gugat keselamatan dan ketenteraman awam termasuklah sabotaj, subversif, pengintipan(espionage), ekstremis agama dan kaum, keganasan dan militan.

Selain itu, maklumat risikan dari dalam dan luar negera terutamanya dari badan-badan keselamatan awam negara luar juga diambil kira.Penilaian tahanan ISA diasaskan kepada maklumat terperinci pihak polis. Sekiranya  tiada sebarang bukti, tahanan dibebaskan mengikut masa tertentu.

Peruntukan undang-undang Kanun Acara Jenayah dan Kanun Keseksaan, tidak mempunyai peruntukan untuk membicarakan kes-kes ISA.

Apakah yang dimaksudkan dengan penahanan?

Seksyen 73 (1) ISA memberi kuasa kepada polis mengambil tindakan awalan menahan mana-mana individu/kumpulan yang dianggap boleh mengancam keselamatan dan ketenteraman awam. Seksyen ini membolehkan polis menahan individu berkenaan selama;
a) 1 hari 1 malam (24 jam)
b) 2 hari 2 malam (48 jam)
c) 1 minggu (168 jam)
d) 60 hari (1440 jam)

Jika pihak polis belum berpuas hati selepas 60 hari, ia perlu memaklumkan kepada Menteri Hal Ehwal Dalam Negeri dengan mengemukakan hujah-hujah yang kukuh bagi membolehkan tahanan dilanjutkan lebih daripada 60 hari.

Benarkah ISA dikatakan bertentangan dengan hak asasi manusia?
Sebenarnya dalam masa 3 bulan tahanan boleh dirujuk kepada Lembaga Penasihat Tahanan mengenai hak mereka  dengan  membawa  peguam  mereka bersama-sama dengan Lembaga Penasihat Tahanan. Sekiranya Lembaga Penasihat mendapati tahanan berkenaan masih ada ancaman keselamatan maka, tahanan boleh dilanjutkan sehingga 60 hari.

Adakah ruang rayuan untuk mereka yang ditahan?

Walaupun peruntukan 73(1) menyatakan pihak polis tidak perlu merujuk kepada Menteri Dalam Negeri, namun tahanan mempunyai hak untuk mencabar kesahihan penahanan mereka dan juga berhak membawa keluarga bersama peguam berhadapan dengan Lembaga Penasihat.

Selepas 60 hari, jika pihak polis mendapati masih ada ancaman kepada keselamatan negara maka perakuan hendaklah dibuat kepada  Menteri Hal Ehwal Dalam Negeri mengikut peruntukan seksyen 8(1) atau  8(5) dimana Menteri akan melihat hujah-hujah pihak polis untuk menahan individu berkenaan melebihi 60 hari.

Selepas Menteri Hal Ehwal Dalam Negeri mengkaji hujah-hujah yang dikemukakan oleh pihak polis Menteri perlu menurunkan tandatangan ke atas dokumen yang dipanggil perintah terhad (Detention Order).

Adakah negera-negera lain mempunyai akta yang serupa ISA?

Beberapa negara lain turut mempunyai undang-undang yang meyerupai ISA untuk mempertahankan keselamatan negara mereka dari ancaman dalam dan luar.

Singapura mempunyai ISAnya tersendiri bagi tujuan menahan individu yang dianggap boleh mengancam keamanan dan keselamatannya. Pada 1963 dalam operasi Coldstore seramai 100 individu-individu terdiri dari ahli-ahli politik dan persatuan telah ditahan. Pada 2006, Singapura  menahan Mas Selamat Bin Kastari, anggota (JI) Jamaatul Islamiyyah.

Brunei  juga berhadapan dengan ancaman tertentu dan ISA telah digunapakai.

Filipina, Thailand dan Indonesia tidak mempunyai  akta  bertulis   seperti  ISA. Mereka  menggunakan undang-undang sedia ada untuk menangani individu-individu yang menjejaskan keselamatan negara mereka.

Di Indonesia, aktivis-aktivis Jamaatul Islamiyyah (JI) begitu aktif dan mereka telah melakukan pengeboman di beberapa hotel terkemuka di Jakarta pada 17 Julai 2009. Pada 2002, Bali juga menghadapi pengeboman yang telah mengorbankan 202 orang, majoritinya pelancong dari Australia.

Negara Thailand mengakui bahawa Malaysia adalah satu-satunya Negara aman yang mempunyai akta khusus untuk menghadapi ancaman yang memudaratkan Negara.

Amerika Syarikat sebuah negara yang mengagungkan demokrasai dan hak asasi turut mempunyai akta yang serupa yang dipanggil The USA Patriot Act (Providing Appopriate Tools Required to Intercept and Obstruct Terrorism Act).

Akta yang komprehensif itu melibatkan pindaan-pindaan akta lain demi mengukuhkan perpaduan Amerika Syarikat. Misalnya, Patriot Act  membolehkan pindaan dibuat kepada akta Immigration and Nationality Act (INA).

Ia membolehkan menahan seseorang asing yang membahayakan keselamatan AS sehingga 90 hari dan paling lama 6 bulan jika diperlukan.

Dalam kes pengeboman New York Trade Centre pada 9 September, ramai individu dari negara asing yang disyaki  terlibat dalam tragedi itu ditahan dan dipenjarakan di penjara Guantanamo Bay sehingga kini,  termasuk 2 dari rakyat Malaysia.

Akta ini walaupun diterima oleh majoriti ahli kongres tetapi telah dikritik keras oleh kumpulan-kumpulan hak asasi manusia, namaun kerajaan AS tetpa mempertahankannya.

Di United Kingdom, akta  seperti ISA yang dipanggil Terrorism Act yang bukan baru telah diguna pakai untuk berdepan dengan terrorism di utara Ireland.

Adakah ISA releven dengan pandangan Islam?

Doktor Borhanuddin Al Hilmi pengasas Parti Islam SeMalaysia (PAS) membuat perbandingan tentang ISA dengan sebilah pisau yang tajam yang boleh digunakan untuk kebaikan, dan pada masa yang sama juga boleh digunakan untuk keburukan.

Ibnu Najim berpendapat:
“Sesuatu tindakan yang diambil oleh pemerintah yang pada pandangannya boleh menjaga kepentingan umum, sekalipun tidak terdapat dalil yang khusus mengenainya boleh dilaksanakan”.

Doktor Mohamad Mahmud Al Khalidi dalam kitabnya ”Qawa’id Nizam Al Hukmi Fi Al Islam” sebuah tesis Ph.D beliau menyatakan:
“Para sahabat juga sependapat mengatakan bahawa melaksanakan    peraturan yang   didokong   oleh pemerintah   adalah   wajib   dan   tidak  halal  bagi  seseorang muslim mengikut hukum, undang-undang serta sistem pentadbiran yang lain dari apa yang ditentukan oleh pemerintah”.

Misalnya, apabila pemerintah telah menentukan undang-undang berkaitan  jalan raya, seluruh umat wajib disisi syarak mematuhi apa yang diperintah oleh Ketua Negara.  Prinsip Sad Az Zara’ie iaitu: “Membendung Punca Keburukan”

New Sem, New Year, New Beginning :)

Hello! Hola! Ni hao! Hye! (^.^)v

I am so happy welcoming myself again to the blogging world :p

It was a very long time for the previous to be updated, isnt it so?

Lame excuse! Urgh! I am just so lazy to update, unlike other people who doesnt mind kept on sharing their activities, programs, ideas, thoughts and expressions. But as for me, at times it should be okay but at times I really hate it when people making some of my blog statements or entry as their propaganda & controversies! HUH!

Okay, go away with that. SYOHHHHHHH!! hahahaha! :p

It's week 9 in MMU now. But I really don't think this is how I should act by this time. I am still in the state of uncertainty and day-dreaming that it has reach W9! still thinking I'm in the early trimester, haih! Delta 1st (Law) is really sickening! Damn a lot of theories and STATUTES! urghhhh!! I've highlighted all related sections and also I've sticked them each with my colorful sticks haha! So colorful yet helpful! I loike! :D Anyone who had ever seen my National Land Code, Companies Act would know HOW NICE there are hahaha! opseyh! :D

As for this semester, I'm reading for part 1 of 5 subjects namely Land Law, Company Law, Equity and Trust, Public International Law and also Law and Information Technology. Each and every subject is so stressing on the theoretical and applications to have each the arguments and best solution to be given out. Being a law student, one should have the knowledge of giving advice and legal 'counseling' to the clients, as for now the 'client' is our own lecturers! How pathetic! huhuhuhu! I sympathize my lecturers for having my arguments as it was never good, I tend to write rubbish I might consider. However, thanks to them for having their time, efforts and knowledge to teach me for becoming a lawyer in the future :) Thanks all!

Oh ya, basically land law refers to the applications and uniformity of land law in Malaysia through National Land Code 1965. It is not an Act but is a Code. This is because each states in Malaysia has their own authority to deal with land matters as this falls under State List, conferred in the Malaysia Federal Constitution. However, NLC is being referred to give a standardization to the land disputes among the parties. Indeed, it helps so much to give justice to the deprived parties. This scope of law as so far I am concern and learned are referring to the emerging torren system which was originated from South Australia. It is a system of record, not of land tenure, and is readily adaptable to any form of land tenure. By having this torren system, any land is only effective after such land is being registered. Fail to do so does not amount the land to be regarded as an ownership until is it registered. Another topic is that on the fixture and chattel. Fixture? Anything attached to the land is a fixture. For example, garage, house, door & windows, also any bolts and nuts screwed in the house. As for chattel, anything that are for the enjoyment of the land such as tables, fridge and cupboard. Not only that, I have learnt Temporary Occupational Licence (TOL) which regards to the alienation of land by State Authority to citizen. This TOL is not permanent; it dies along with the death of the person having the TOL. So whoever has house built in the piece of land, better be careful as you won't be getting anything as house is attached to land; it is a fixture, so by definition of land, it includes anything attached to the land. Once the licensee is death, the duration of TOL also come to an end even though it has not reached the time. And I have lot more to learn! :D

That's land law. What about company law? This is the most TOUGH subject this sem! There were too many sections that I MUST UNDERSTAND! DAMN A LOT! Seriously! I sticked to each sections so I may refer to it easily. I learn on the formation of companies; partnership, private limited company by shares and guarantee also public companies. And not only that, I should know who are acting on behalf of the companies; and they are known as promoters. Those who are not having the authority to act for the company are not regarded as promoters. I remembered this one subtopic on lifting the corporate veil. I was thinking that only houses are having veils, unexpectedly company law also has veil hahaha! :p It gives headache learning Article of Association and Memorandum of Association, sigh! I also need to know what incorporation really is and when shall a company is being incorporated. As for this, a company is only being incorporated and being an entity when the Registrar delivered to them a certificate of incorporation. However, it does not mean that such company cannot enter into any contracts prior to their incorporation. However, those contracting companies should be alert with the condition as to avoid conflict in the future. The contract can be enforced once the newly incorporated company choose to ratify it :) And there are a lot more!

Hohohoho! Public international law! I like this subject! Hahahaha! :p Why? Simply because it is a law of international that governs through signing of treaties between ratifying states. Also, it should be noted that how it comes to a single law when different countries in the world are having their own sovereignty law. The definition of international law itself is ambiguous. Generally, it might be understood as a law that is having all the fundamental and universal law opt by most nations in the world. One of the common question popped is that which one prevails? International law or municipal law? This is a very conflicting issue up until now. It however depends on the school of thoughts by Monoism and Dualism. Monoism thinks it goes along and work together, and international law shall prevail. But this is different to Dualism when they think that it never does as both laws work on their own spheres and jurisdictions. It might intervene other law of sovereign countries. This subject also taught on the international relations with any governments of countries that are being recognized. Certain states in the world are not being recognised for its government due to certain factors. For example are East Timor (Timor Leste). Even though it is an independent state, but Indonesia put on restrictions to other states not to have any relation with East Timor since it gained its independence through Indonesia. Apart from that, another independent state that really is independent is Iran. They have their own political control and not being controlled by other sovereign like what is happening to Iraq & Afghanistan where US is the mind-master who is funding those states. An independent state can have any diplomatic relations with any other states, also free to enter into treaty making and also able to respond to international claim; Iran nuclear issue. As regards to this, Iran have their own stand and they are sovereign although other states may oppressed them. Iraq & Agfhanistan; the similarities is that they are inchoate states on which such government are not recognized; Taliban of Afghanistan. Furthermore, these two states, although having the so called 'government' have no army troop. They are 'protected' by US Army. The sovereignty of such states lies on the state having the army and sovereign law that other states shall not interfere in the municipal law and internal issues. 

Oh! This is so daymn long! I shall put a pause first before I complete this with other 2 subjects; Equity & Trust and Law & IT in the next entry. It's late; 0246am and I have 8am morning class tomorrow! It will be a hectic day with 6 hours of lectures tomorrow; 8-10am Land Law, 12-2pm Public International Law and 8-10pm Company Law. Sigh!  Shall begone by now! I shall continue with my understanding of what I had learn so far :) InsyaAllah :)

As for that, do review if I had done any unintentional mistake to my own understanding. I am in the learning process, so anyone who has more knowledge than I do; I welcome any of you to correct me :)

haih, sekarang ni memang aku tengah mengeluh giler..rasa berat jek keluhan tu..mane taknye, isnin & selasa ni final exam paper torts 2 ngan criminal 2 tp ape yang aku buat spnjg cuti ni? aku xbelajar pun! rasa malas tu, ya Rabbi..amat yang malas! ada jugak aku belek2 buku & notes malam2 before tido ngan lepas sahur, tp cam xmemadai..raya ni lagi la, buku cam perkara paling nk dijauhkan haih! kenapa? sebab jumpe katil, tilam, bantal & blanket kesayangan yang sepertinya xnk bagi aku bangkit dari tdo haha! xde la, tu cerita laen..

aku duduk di rumah seperti melepaskan tekanan yang terperap..kenapa? sebab di rumah ni aku bebas bergerak..nak bgolek bguling2 ke, nk dok melepak dpn tv ke, kat tmn ke, kebun ke suke suki aku..tp if blk mmu? dok ep tu rasa cam, ya Rabbi........rasa terkongkong giler! pergerakan terbatas, nak study pun xlapang..tp kn study gak kan? terpaksa study dlm keadaan camtu..

bukannye xleh study kat umah, boleh jek sbnrnye..tp maybe cuti raya ni lagi membantutkan mood study..mane xnye, pegi beraya, orang non-stop dtg beraya, makan itu ini haih..pastu mate pun asyik kuyu jek..time bulan pose tu, cun jek bley tahan..aku terpikir jgk, maybe disebabkan pola pemakanan aku la yang menyebabkan aku bley tahan ngantuk or mata kuyu..if berlebih2an, ha siap la..di alam mimpi la jawabnye..tu yang size makin menjadi2 tu hehe.. :p in conlclusion, kena la jaga pemakanan yang betul untuk kesihatan :)

dlu if study kat umah, after maghrib jek slmt dah aku bukak buku til late midnight..ni time dh besar ni la..tp since raya ni, cam xde can nk bukak buku..ada jek kije haih..so skang ni mmg la tengah ngadap text book torts, tp cam xall out..risau tu risau, tp kalau xall out camane? xke hampeh tu?

saje jek ni nk melalut2..td ibunda baca blog daku & fateen..bguling2 dia gelakkan aku bile bace blog fateen tu haih..sabo ajo la den dgn ayat2 blog gadis sengal si fateen tu hahahaha :p jadi skang ni yang penting is.. BELAJAR LA JUZALIANA OYTTTTTTTTTTTTTTTTTT!!!!
